Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the website located at www.rrwaterproofing.co.za and your engagement with the services provided by RR Roof Waterproofing (Pty) Ltd ("we", "us" or "our"), registered and operating in South Africa.

By accessing our website or engaging our services, you agree to be bound by these Terms. These Terms are governed by and construed in accordance with the laws of the Republic of South Africa, including the Electronic Communications and Transactions Act 25 of 2002 (ECT Act) and the Consumer Protection Act 68 of 2008 (CPA).

If you do not agree to these Terms, please do not use our website or services.

2. Our Services

RR Roof Waterproofing provides professional roofing and property maintenance services including, but not limited to:

  • Roof waterproofing and torch-on waterproofing
  • Roof painting and protective coatings
  • Roof repairs and maintenance
  • Gutter installation and maintenance
  • Damp-proofing
  • Isotherm insulation installation
  • Ceiling installation and repairs
  • Interior and exterior house painting

All services are subject to a formal quotation and written agreement between the parties prior to commencement of work.

3. Quotations

All quotations provided by us are:

  • Free of charge and without obligation
  • Valid for 30 days from the date of issue, unless otherwise stated
  • Based on the information provided at the time of assessment — additional costs may apply if unforeseen conditions are discovered during work
  • Subject to written acceptance before work commences

We reserve the right to withdraw or amend a quotation at any time before written acceptance.

4. Payment Terms

Unless otherwise agreed in writing:

  • A deposit may be required prior to commencement of work, as specified in the quotation
  • The balance is due on completion of the work, unless a payment schedule has been agreed in writing
  • We reserve the right to charge interest on overdue amounts at the maximum rate permitted under the National Credit Act 34 of 2005
  • Ownership of any materials supplied remains with RR Roof Waterproofing until full payment has been received

5. Warranties and Guarantees

Where warranties or guarantees are offered, they apply under the following conditions:

  • Warranties are void if damage arises from misuse, neglect, alterations by third parties or causes beyond our control (including acts of nature)
  • Warranties cover workmanship defects and are limited to the scope of work performed by RR Roof Waterproofing
  • Product guarantees are subject to the terms of the respective manufacturer
  • Warranties are non-transferable unless otherwise stated in writing

These warranties are in addition to, and do not limit, your statutory rights under the Consumer Protection Act 68 of 2008.

6. Consumer Protection Act Rights

As a consumer in South Africa, you are protected by the Consumer Protection Act 68 of 2008. In accordance with the CPA:

  • You have the right to fair value, good quality and safety in respect of goods and services provided
  • You have the right to disclosure of information and honest dealing
  • You have the right to cancel fixed-term agreements with reasonable notice, subject to any applicable cancellation fees
  • You may refer any unresolved disputes to the National Consumer Commission or the relevant Consumer Court

7. Limitation of Liability

To the extent permitted by law:

  • Our liability in respect of any claim arising from our services is limited to the value of the services performed
  • We are not liable for any indirect, consequential or special damages, loss of profit or loss of data arising from the use of our services or website
  • We are not responsible for pre-existing defects or damage that was not caused by our workmanship

Nothing in these Terms excludes liability for gross negligence, fraud or any other liability that cannot be excluded under South African law.

8. Use of Our Website

When using our website, you agree to:

  • Use the website only for lawful purposes and in accordance with the ECT Act
  • Not attempt to gain unauthorised access to any part of the website or its underlying infrastructure
  • Not use the website to transmit any harmful, offensive or unlawful content

We reserve the right to restrict or terminate access to the website at our discretion, without notice.

9. Intellectual Property

All content on this website, including text, images, graphics, logos and design, is the property of RR Roof Waterproofing (Pty) Ltd or its content suppliers and is protected by applicable South African and international intellectual property laws. You may not reproduce, distribute or use any content without our prior written consent.

10. Privacy and Personal Information

The collection and use of your personal information is governed by our Privacy Policy and our POPIA Compliance Statement, which are incorporated into these Terms by reference.

11. Dispute Resolution

In the event of a dispute:

  • We encourage you to contact us directly so that we can resolve the matter amicably
  • If the matter cannot be resolved directly, either party may refer the dispute to a mediator agreed upon by both parties
  • If mediation fails, the dispute will be referred to the jurisdiction of the South Gauteng High Court, unless the matter falls within the jurisdiction of the Magistrates' Court
  • Consumer disputes may also be referred to the National Consumer Commission in terms of the Consumer Protection Act

12. Changes to These Terms

We reserve the right to update or amend these Terms at any time. Updated Terms will be posted on this page with a revised "last updated" date. Continued use of our website or services after any changes constitutes your acceptance of the revised Terms.
